These Terms of Use govern the rights, obligations, scope of license, and limitations of liability between you and the platform operator when you access and use TW Market Data. Please read these Terms in full before using the Service.
When you register an account, create an API key, access the Service, call the Service API, or otherwise use the Service, you represent that you have read, understood, and agree to be bound by these Terms; if you do not agree to all or part of these Terms, please stop using the Service.
These Terms apply to your use of the platform website, datasets, API, documentation, console, downloadable content, and related features.
The platform may separately publish supplementary rules for specific features, plans, promotions, beta features, or enterprise partnerships; once published, such supplementary rules form part of these Terms.
Unless the context otherwise requires, the terms used in these Terms are defined as follows.
The platform provides a Taiwan stock data API, dataset access capabilities, a console, documentation, and related product interfaces.
The datasets, features, access boundaries, quotas, rate limits, license scope, and other conditions of use actually available under the Service are governed by your current account plan, the product interface, the subscription page, or any individual agreement.
The platform may, based on product development, source availability, regulatory requirements, technical maintenance, or other reasonable factors, add, adjust, suspend, remove, or replace certain datasets, fields, features, quotas, rate limits, or product content, and may notify users by website announcement, console notice, email, or other reasonable means.
You shall properly safeguard the security of your account and API key, and shall not transfer, sell, share, rent, lend, or otherwise provide your account or API key for unauthorized use by any third party.
You are solely responsible for all activity and requests made under your account and API key.
If you discover that your account or API key is suspected of being leaked, subject to unauthorized access, used abnormally, or presents any other security concern, you shall immediately notify the platform and take necessary measures to disable, reset, or rotate it.
The platform may, based on information security, abuse prevention, system stability, regulatory compliance, or reasonable risk control needs, suspend, restrict, revoke, reset, or require replacement of a specific account or API key.
Subject to the plan applicable to you, the platform grants you a revocable, non-exclusive, non-transferable, non-sublicensable right of use to access and use the Service within the scope of the license.
The price, billing cycle, license scope, dataset availability, quotas, rate limits, number of API keys, and related features of a paid plan are governed by the content set out on the website, console, order, or other official page at the time you subscribe or purchase.
The platform may, based on product, cost, regulatory, or operational needs, adjust plan prices, feature content, quotas, rate limits, dataset scope, or other plan conditions, taking effect after announcement or notice by reasonable means.
If you fail to pay as agreed, a payment fails, a refund dispute arises, or there are other reasonably necessary circumstances, the platform may restrict, suspend, or terminate your use of part or all of the Service.
Plan upgrades and downgrades, effective times, data access scope, and the manner of switching account permissions are governed by the product interface and plan rules in effect at the time.
The data provided by the platform may include content from official sources, public sources, third-party sources, or content compiled, standardized, structured, or derived by the platform according to certain methods. Different data sources may be affected by their original license conditions, availability, update frequency, technical limitations, latency, corrections, and interruptions.
You understand and agree that the continued supply, content quality, and lawful availability of Third-Party Data may be affected by third-party factors.
You remain responsible for judging whether the data is suitable for your intended purpose, and for confirming whether it complies with applicable laws, third-party rights, and your internal compliance requirements.
The platform does not guarantee that any Third-Party Data will be provided perpetually and continuously, will remain entirely unchanged, or may be used without restriction under any circumstances.
The Service and all of its data, content, documentation, fields, indicators, events, model outputs, and related information are provided on an "as is" and "as available" basis.
To the extent permitted by applicable law, the platform makes no express or implied warranty as to accuracy, completeness, timeliness, continuous availability, freedom from error, freedom from interruption, fitness for a particular purpose, or full conformity with your expectations.
You understand that data may experience delay, omission, correction, amendment, restatement, backfill, suspension, removal, or source interruption.
TW Market Data (TWMD) provides historical data and statistics, not investment advice; investment decisions and their risks are your own.
The data, fields, indicators, events, news, valuation information, derived information, documentation content, or any explanation provided by the platform do not constitute investment advice, investment solicitation, buy/sell recommendations, guarantees of returns, legal opinions, accounting opinions, or tax opinions.
You should not treat the platform's data or content as a recommendation, offer, or endorsement of any financial product.
Any investment, trading, asset allocation, risk management, or business decision shall be made at your own judgment and risk; where necessary, you should consult your own professional advisors.
If any of the following circumstances occurs, the platform may, to the extent necessary, suspend, restrict, or terminate your access to all or part of the Service.
The intellectual property rights in the platform website, interfaces, code, design, documentation, trademarks, data compilation methods, data structures, textual content, and other related content, except as otherwise stated, belong to the platform or its lawful rights holders.
Except as expressly licensed under these Terms, you acquire no other intellectual property right, ownership, sublicensing right, or right to reproduce, distribute, publicly transmit, or adapt the data by using the Service.
The platform values user privacy. The collection, processing, and use of personal data involved in your use of the Service are handled in accordance with the platform's Privacy Policy.
Please read the Privacy Policy carefully before use to understand how the platform processes data and your rights.
The platform may change part or all of the Service based on maintenance, upgrade, security, performance, testing, correction, or architectural adjustment needs.
During maintenance, updates, testing, or troubleshooting, the Service may be briefly interrupted, delayed, restricted, or render certain features unavailable.
The platform will make reasonable efforts to minimize the impact on users, but does not guarantee that the Service will be free from interruption or anomaly at all times.
To the extent permitted by applicable law, the platform shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use, inability to use, data delay, data error, data omission, service interruption, feature restriction, Third-Party Data anomaly, or other circumstances related to the Service.
To the extent permitted by law, the platform's total liability to you shall be capped at the total fees you actually paid to the platform for the Service in the twelve months preceding the event giving rise to the damage; if you have paid no fees, the minimum extent required by law shall govern.
The interpretation, validity, and application of these Terms shall be governed by the laws of the Republic of China (Taiwan).
For any dispute arising from or in connection with these Terms or the Service, the parties shall first seek to resolve it through good-faith negotiation; if negotiation fails, then unless otherwise mandatorily required by law, the parties agree that the Taiwan Taipei District Court shall be the court of first instance with jurisdiction.
